Acceptance and who we are

These Terms of Use form a binding agreement between you and Policy Impact Communications LLC (PICXM), the Washington, D.C.-based government affairs and integrated communications team. Throughout these terms, we, us, and our mean PICXM. You and your mean the visitor, reader, subscriber, or organization using picxm.com.

By accessing or using picxm.com (the site), subscribing to The Picspective, submitting a form, or otherwise interacting with the digital properties PICXM operates, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site.

Eligibility and authority

You must be at least sixteen years of age, or the minimum age of digital consent in your jurisdiction, whichever is higher, to use picxm.com. If you accept these terms on behalf of an organization, you represent that you are authorized to bind the organization, and you and the organization are both bound by these terms.

PICXM may refuse access, decline service, or terminate use by any visitor, subscriber, or organization at any time, with or without notice, where doing so is consistent with the law and the standards of the firm.

License to use the site

Subject to your compliance with these terms, PICXM grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view picxm.com for lawful, non-commercial informational purposes. You may also link to picxm.com from a non-misleading destination that does not imply endorsement.

All other rights are reserved. This license does not grant any right to download, copy, scrape, mirror, modify, distribute, sell, or create derivative works from the site or its content, except as expressly permitted in writing.

Restrictions and acceptable use

You agree not to:

  • Misrepresent PICXM. Pose as a PICXM principal, employee, or affiliate, or impersonate any user or third party in any forum operated by PICXM.
  • Bypass technical controls. Use bots, scrapers, crawlers, or any automated means to access or harvest data from the site beyond what is permitted for standard search engine indexing.
  • Train commercial AI on the site. Use the site or its content to train, fine-tune, evaluate, or benchmark commercial artificial intelligence systems without our prior written permission.
  • Compromise the site. Probe, scan, or test for vulnerabilities; introduce malware, viruses, or other harmful code; interfere with the site infrastructure or the experience of other users.
  • Use the site unlawfully. Engage in any activity that violates United States law, the laws of your jurisdiction, or the rights of any third party, including intellectual property, privacy, publicity, and contractual rights.
  • Reproduce content without attribution. Republish, syndicate, or reproduce substantial portions of the site without written permission and proper attribution.
  • Use the site to compete. Use the site, the case studies, or the analysis published here to develop a competing communications, government affairs, or AI-search product or service.

Submissions and feedback

When you send us a message through the contact form, reply to The Picspective, submit a request for proposal, or otherwise share feedback, ideas, suggestions, or materials with PICXM (collectively, submissions), you grant PICXM a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and distribute the submission for the purposes of running the firm and improving the site and our offerings.

You represent that the submission is yours to share, that it does not violate the rights of any third party, and that it does not contain confidential information belonging to anyone else. We have no obligation to keep submissions confidential unless we have agreed in writing to do so or unless the submission is governed by a separate engagement agreement or non-disclosure agreement.

Intellectual property and trademarks

All content on picxm.com, including the written essays, The Picspective issues, case studies, photography, video, audio, podcast episodes, design, layout, branding, and software powering the site, is the property of PICXM or its licensors and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

PICXM, Policy Impact Communications, The Picspective, and the PICXM marks and logos are trademarks of Policy Impact Communications LLC. Names of federal agencies, statutes, publications, and third-party brands appearing on the site are the property of their respective owners and are used for identification only. Their appearance does not imply endorsement, partnership, or affiliation unless we have stated otherwise in writing.

Fair use, including for academic, journalistic, and editorial commentary, is preserved by United States copyright law. Brief, attributed quotations of PICXM essays and The Picspective in articles, presentations, and AI-generated answers are welcome with a link back to the source page.

Third-party content and links

The site links to third-party websites, publications, agency pages, partner platforms, and social channels for reference. PICXM does not control, endorse, or warrant any third-party content, terms of service, or privacy practices. Your use of any third-party destination is at your own risk and is governed by the third party's own terms.

References to client engagements, named publications, or industry venues describe historical or public-record work. They are not endorsements by those clients, publications, or venues of PICXM, and they do not imply current or future engagement absent a separate written agreement.

AI tools, AI search, and training

PICXM is AI-native by design. We use AI tools inside the firm under standards explained in our Privacy Policy. The terms below cover your use of PICXM content with AI tools.

Permitted

Quoting brief excerpts of PICXM essays, The Picspective issues, and analysis in AI-generated answers, summaries, and research with clear attribution and a link back to the source page. Citation by AI search engines, large language models, retrieval systems, and answer engines for the purpose of responding to a reader question is welcome.

Not permitted without written permission

Training, fine-tuning, evaluating, or benchmarking commercial AI systems on substantial portions of picxm.com or its content. Republishing PICXM content as part of an AI-generated work without attribution. Using PICXM content to generate look-alike imitations of the PICXM voice for any commercial purpose. Using AI tooling to scrape the site at scale or to bypass technical access controls.

Reservation under Article 4 of the EU DSM Directive

PICXM expressly reserves its rights under Article 4(3) of the EU Directive on Copyright in the Digital Single Market (2019/790) against text-and-data mining of picxm.com for commercial AI training purposes. This reservation is machine-readable through our robots and Terms metadata.

Confidentiality of engagement information

If you contact PICXM to explore an engagement, the information you share is treated as confidential under our standard non-disclosure framework. We do not disclose your inquiry, the topic, or the materials you share except as needed to evaluate the engagement, as required by law, or as you direct in writing.

Public-facing case studies are published only with client permission. Sovereign, regulated, and confidential engagements appear, if at all, in anonymized form. Nothing on picxm.com constitutes a waiver of confidentiality owed to current or former clients.

Content on picxm.com is published for informational and editorial purposes. It is not legal advice, accounting advice, tax advice, lobbying compliance advice, regulatory advice, investment advice, medical advice, or any other form of professional advice. Reading the site does not create a lawyer-client relationship, a consultant-client relationship, or any other professional engagement between you and PICXM.

If you need advice for a specific situation, retain qualified counsel, qualified professional advisors, or engage PICXM under a separate written agreement.

picxm.com and its content are provided on an as-is and as-available basis. To the maximum extent permitted by applicable law, PICXM and its affiliates, principals, officers, directors, employees, contractors, advisors, and licensors disclaim all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currentness, and uninterrupted availability.

We do not warrant that the site will be free of errors, viruses, or harmful components; that any analysis or commentary is suitable for your circumstances; or that the site will meet your requirements. Forward-looking statements about sectors, markets, regulations, AI, or any other subject reflect our perspective at the time of publication and may not reflect future events. We make no representations or warranties concerning the conduct of any third party or the content of any linked third-party site.

Limitation of liability

To the maximum extent permitted by applicable law, in no event will PICXM or its affiliates, principals, officers, directors, employees, contractors, advisors, or licensors be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for lost profits, lost revenues, lost business opportunities, lost goodwill, lost data, or business interruption, arising out of or relating to your access to or use of picxm.com, the content, or any link from the site, whether based on contract, tort (including negligence), strict liability, statute, or any other theory, and even if PICXM has been advised of the possibility of such damages.

PICXM aggregate liability to you for all claims arising out of or relating to these terms or your use of picxm.com will not exceed one hundred United States dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by the law of your jurisdiction.

Indemnification

You agree to defend, indemnify, and hold harmless PICXM and its affiliates, principals, officers, directors, employees, contractors, advisors, and licensors from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your access to or use of picxm.com, your violation of these terms, your submissions, or your violation of any law or any right of a third party.

PICXM reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with PICXM defense of that claim.

Export controls and sanctions

The site is operated from the United States. You agree to comply with all applicable export control laws and economic sanctions, including those administered by the United States Department of Commerce Bureau of Industry and Security (BIS), the United States Department of the Treasury Office of Foreign Assets Control (OFAC), the United States Department of State, and equivalent authorities in your jurisdiction.

You represent that you are not located in, under the control of, or a national or resident of any country or jurisdiction subject to comprehensive United States economic sanctions, and that you are not listed on any United States government list of prohibited or restricted parties. You may not access picxm.com or engage PICXM if doing so would violate United States or other applicable export control or sanctions laws.

Governing law and dispute resolution

These terms and any dispute arising out of or relating to picxm.com or your use of the site are governed by the laws of the District of Columbia, United States, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first

Before filing any claim, you agree to contact PICXM at contact@picxm.com with a description of the dispute and the relief you seek. We agree to attempt to resolve the matter informally for at least thirty days before either party initiates a formal proceeding.

Forum and jurisdiction

If the dispute is not resolved informally, the federal and state courts located in the District of Columbia have exclusive jurisdiction over any claim arising out of or relating to these terms or your use of picxm.com. You consent to the personal jurisdiction of those courts and waive any objection to venue.

Class action and jury waiver

To the maximum extent permitted by applicable law, any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and PICXM each waive the right to a jury trial in any proceeding arising out of or relating to these terms.

Statute of limitations

Any claim arising out of or relating to picxm.com or these terms must be filed within one year after the cause of action arises, except where prohibited by applicable law.

Changes to these terms

We may update these terms when the site, the services we offer through it, or the applicable law changes. The current version always lives at picxm.com/terms with the Effective date and Last updated noted in the hero above. We retain prior versions for at least five years and provide a copy on request at contact@picxm.com.

When the change is material, we notify Picspective subscribers by email at least thirty days before the change takes effect. Your continued use of picxm.com after the effective date of any change constitutes acceptance of the updated terms.

Severability, entire agreement, and contact

Severability

If any provision of these terms is held to be unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

No waiver

The failure of PICXM to enforce any right or provision of these terms is not a waiver of that right or provision.

Assignment

You may not assign or transfer these terms, by operation of law or otherwise, without our prior written consent. PICXM may assign or transfer these terms in connection with a merger, acquisition, reorganization, or sale of substantially all PICXM assets, with notice but without your consent.

Entire agreement

These terms, together with our Privacy Policy and any separate written agreement governing an engagement between you and PICXM, constitute the entire agreement between you and PICXM concerning the site and supersede all prior or contemporaneous communications and proposals on the subject. A separate engagement letter or master services agreement, where signed, controls over these terms with respect to the matters it covers.
